These Terms & Conditions (“Terms”) apply to auctions, bidding activities, purchases, and applicable services and communications provided by Boone Marketing Incorporated, doing business as Jeff Boone Auction & Realty (“Boone Auctions,” “Jeff Boone Auction & Realty,” “we,” “us,” or “our”).
All bidders acknowledge that they have read, understand, and agree to the following Terms & Conditions established by Jeff Boone Auction & Realty. All bidders agree to be legally bound by these Terms.
Each auction may have its own additional or different auction-specific terms and conditions. In the event of a conflict, the terms specifically posted for that auction and any announcements, modifications, or corrections made by the Auctioneer shall control and supersede these general Terms and any other printed or previously published material.
Please review the specific terms and conditions for each auction before bidding.
Boone Auctions reserves the right to deny, suspend, or terminate bidding privileges at any time.
By registering or placing a bid, the bidder acknowledges and agrees to comply with these Terms and any auction-specific terms applicable to the auction.
A buyer’s premium may apply to purchases.
The applicable buyer’s premium, if any, will be disclosed in the auction-specific terms and/or on the applicable bidding platform. Because buyer’s premiums may vary by auction, no single buyer’s premium percentage applies to all Jeff Boone Auction & Realty auctions.
Once invoiced, buyers have 24 hours to contact Boone Auctions to notify us of payment arrangements.
Please note that any purchase is subject to automatically being charged to the credit card on file.
If you prefer to pay another way, please contact us immediately following the auction with your bidder number and invoice number to inform us of your payment and pickup details by emailing JeffBooneAuctions@gmail.com.
Boone Auctions has the right to charge your card on file if no communication has been made regarding payment preference.
Cash & Check: Accepted with no extra fee.
Wire Transfer: Accepted with a $20 fee from the Auction Company that will be added to your invoice before payment.
Credit & Debit Cards: Accepted with a 3.99% charge in addition to the purchased amount.
These payment terms apply to onsite and Internet bidders unless auction-specific terms provide otherwise.
Any unpaid bills may result in revoked bidding privileges and/or immediate legal action.
7% Indiana State Sales Tax will be charged unless proof of exemption is provided.
All titled items will be charged sales tax at the rate applicable where the vehicle will be titled, up to a maximum of 7%, unless purchased by a registered dealer. This applies to in-state and out-of-state purchasers.
All bidders understand that they will be liable for payment of sales or use taxes that may become due as a result of failure to comply with applicable federal, state, and local tax laws for items purchased as tax-exempt or for resale.
All bidders understand that providing a false or improper exemption certificate for taxable items may subject the purchaser to penalties under applicable law.
A Titled Vehicle Entry Fee will be added to all titled items:
$20 paid by the Seller
$40 paid by the Buyer
The fee includes title processing, including preparation of applicable paperwork and documents needed for the buyer’s local BMV, and USPS Priority Mail delivery with tracking when applicable.
Cash buyers of titled items may take the title upon payment if the title is present.
Buyers paying by check will receive the title upon the check clearing.
For items noted “Title to Arrive,” titles may take up to 30 days to arrive when obtaining a title from a lender and/or waiting to receive it from the BMV.
Boone Auctions will secure titles and distribute them as soon as reasonably possible for each titled item.
Items identified as “Title to Arrive” or “Title Present” will have a title.
If the listing does not mention a title, bidders should assume there is no title and that the item is being sold without one.
All purchased items become the responsibility of the purchaser as soon as the item is sold.
Any items not picked up by the required pickup date may be charged a storage fee of up to $100 per day.
If an item is not picked up by the next consignment auction, the Auction Company may sell the item at No Reserve and mail the original purchaser a check for the remaining balance after all applicable fees are deducted.
The Auction Company is not responsible for lost, stolen, or damaged items.
It is the buyer’s responsibility to insure purchases as needed immediately upon purchase.
Immediately when an item is sold, it becomes the property and responsibility of the buyer.
ALL ITEMS SELL “AS-IS” AND “WHERE-IS,” WITH NO WARRANTIES OR GUARANTEES BY THE SELLER(S) OR THE AUCTION COMPANY. ALL SALES ARE FINAL.
Descriptions concerning condition, hours, use, mileage, specifications, age, authenticity, or other characteristics are provided as a courtesy and are not guaranteed by the Seller(s) or the Auction Company.
The bidder is responsible for determining his or her own opinion of the condition, authenticity, suitability, and value of an item before purchasing the item, not after.
It is the buyer’s responsibility to inspect any item of interest before bidding.
Online bidders understand and acknowledge that they may not be able to inspect an item as thoroughly as they could through an in-person examination.
It is the bidder’s responsibility to determine condition, age, genuineness, value, and any other determinative factor.
Boone Auctions will endeavor to describe each item and provide pertinent information about it; however, bidders must make their own determinations before bidding.
After a bidder has won the bid, all risk of loss and damage passes to the bidder, even if the bidder has not yet paid for the item.
Buyers should guard and insure their purchases accordingly.
The Seller(s), Auction Company, and its associates are not responsible for loss, theft, damage, or accidents involving purchased property.
Boone Auctions will not be responsible for errors or omissions in descriptions of merchandise unless there is a material and intentional misrepresentation of the item itself.
Bidder acknowledges and agrees that items are sold as-is and that purchased items may not be returned.
Photographs, videos, descriptions, measurements, hours, mileage, specifications, serial numbers, model information, and other information are provided to assist bidders but are not substitutes for the bidder’s own inspection and evaluation.
By placing bids online, bidders agree to follow all applicable Terms & Conditions, make payment for purchased items, and take possession of purchased items.
Although Boone Auctions strives to provide reliable Internet connections, software, and online bidding services, Internet speeds, connectivity, equipment, and software reliability may vary.
The Auction Company is not responsible for lost connections, Internet failures, equipment failures, software failures, platform failures, or other technical problems that result in lost, delayed, unaccepted, or missed bids.
Bidder acknowledges and understands that an online bidding service may or may not function correctly on the day of the auction.
Under no circumstances shall a bidder have a claim against Boone Auctions arising solely because an Internet service, bidding platform, connection, or related technology fails to operate correctly before or during an auction.
Boone Auctions will not be responsible for missed bids from any source.
Internet bidders who want to make certain their bid is acknowledged should consider leaving their maximum bid in advance and contacting the Auction Company if they have questions or concerns regarding the bidding process.
Bidders should not assume that a bid submitted during the final seconds will be received or accepted before bidding closes.
All online bidders are responsible for maintaining control of their online bidding accounts.
You are responsible for every bid placed through your account, whether accidental or intentional.
Online bidding is a serious matter. Bidders are responsible for understanding how the applicable bidding platform operates before placing bids.
Auctions may be conducted live, online-only, simulcast, or through multiple bidding platforms.
When an auction uses multiple bidding methods or platforms, bids may be received simultaneously from in-person bidders and/or competing online platforms.
A bidder is not guaranteed to be the successful bidder merely because an item sells for the same amount the bidder entered as a maximum bid.
Maximum bids function as bidding instructions or a bidding safety net within the applicable platform. An in-person bidder or bidder using another platform may reach the same bid amount before your platform advances your bid.
When live bidding is available, bidders who wish to actively monitor their position are encouraged to watch the auction live because they may be outbid or a competing bid may land at the amount of their maximum bid.
Although Boone Auctions strives to minimize changes, Boone Auctions reserves the right to withdraw, modify, combine, divide, or re-catalog items at any time.
All auctions are considered to be with reserve unless specifically stated otherwise.
Reserves, if any, are not disclosed.
All bidders agree to receive text, email, and/or postage notifications about our upcoming events.
Additional terms apply to participation in the Jeff Boone Auction & Realty SMS Messaging Program as described below.

Individuals who opt into the Jeff Boone Auction & Realty SMS Messaging Program may receive recurring SMS/text messages from Jeff Boone Auction & Realty.
Messages may include auction-related, transactional, informational, customer-service, marketing, promotional, and other communications relating to Jeff Boone Auction & Realty’s products, services, events, and business activities.
Users may opt into the program through methods made available by Jeff Boone Auction & Realty, including by texting a designated keyword to a telephone number published or provided by Jeff Boone Auction & Realty.
Message frequency varies based on auction activity, registrations, transactions, and the messaging programs you have opted into.

Every auction may have additional or different terms concerning matters including payment, buyer’s premiums, pickup, removal, shipping, taxes, titles, bidding procedures, reserves, and other auction-specific requirements.
Bidders are responsible for reviewing the terms applicable to each auction before bidding.
In the event of a conflict between these general Terms & Conditions and the terms specifically published for an individual auction, the auction-specific terms shall control.
Announcements, modifications, or corrections made by the Auctioneer concerning an auction shall supersede previously published or printed information relating to that auction.
